IWUF. RESULTADO APELACIÓN FEDERACIÓN EUROPEA DE WUSHU (EWUF) (Idiomas: inglés y castellano)

 

El 15 de abril de 2021, la Junta Ejecutiva de la IWUF ratificó la Suspensión Provisional de la Federación Europea de Wushu-Kungfu (EWUF).

El 7 de mayo de 2021 el presidente de EWUF (Raymond Smith) presentó una apelación sobre los motivos de la suspensión de la Federación Europea de Wushu-Kungfu.

De acuerdo con el Artículo 38.8 de la Constitución de la IWUF, se formó un Jurado de Apelación para revisar el documento presentado por el Presidente de la EWUF, Sr. Smith:

El jurado de apelación estuvo presidido por el destacado abogado suizo Marc Cavaliero, apoyado por el miembro del Comité Ejecutivo, Chong Kim Fatt (Malasia), y el abogado y miembro de la IWUF, Travis Jon Lamb (Samoa).

Después de la deliberación del documento, el Jurado de Apelación tomó una “Decisión del Jurado de Apelación” de 19 páginas, que ha sido confirmada por la IWUF (EB) de conformidad con la Constitución el 15 de octubre de 2021.

En resumen final, el Jurado de Apelación concluyó:

“El Jurado de Apelación consideró todos los argumentos de la Apelante (EWUF) y la IWUF, y concluyó que la apelación es considerada inadmisible, ya que fue interpuesta contra una decisión, que no es definitiva y vinculante.

Independientemente de lo anterior, el Jurado de Apelación analizó todos los argumentos de la Apelante planteados sobre el fondo y los desestimó todos ”.

En consecuencia y habiendo sido rechazada la Apelación de la EWUF, el Comité de Ética de la IWUF reanudará su investigación sobre EWUF y sus miembros de la Junta.

"On April 15, 2021 the Executive Board of IWUF ratified the Provisional Suspension of the European Wushu Kungfu Federation (EWUF) – ‘the Appellant’.   On May 7, 2021 the President of EWUF (Raymond Smith) lodged the grounds of appeal to this suspension.

In accordance with Article 38.8 of the IWUF Constitution, a Jury of Appeal was formed to review the matters raised by Mr. Smith.

The Jury of Appeal was chaired by noted Swiss Attorney Marc Cavaliero, supported by EB Member Chong Kim Fatt (Malaysia), and Attorney and IWUF Member Travis Jon Lamb (Samoa),

After due deliberation the Jury of Appeal provided a 19 page “Decision of the Jury of Appeal,” which has been confirmed by the IWUF EB in accordance with the Constitution on October 15, 2021. In final summation the Jury of Appeal concluded:

“The Jury of Appeal considered all the arguments of the Appellant and IWUF and concluded that the appeal shall be considered inadmissible, as it was lodged against a decision, which is not final and binding.

Irrespective of the foregoing, the Jury of Appeal analysed all the arguments of the Appellant raised on the merits and dismissed them all.”

Accordingly, as the Appeal by EWUF, now having been rejected, the IWUF Ethics Committee will resume its investigation into EWUF and its Board members."
